The Syndicate for Human Equity, Inc. (“The SHE Mark”) respects the privacy of our users, affiliates, customers, and visitors to our Website, www.theshemark.com (together with all microsites or subdomains hosted thereunder, as well as but not limited to our applications for any SHE Marks, our Shopify storefront, and the SHE Certified Community, collectively referred to herein as the "Site"). The SHE Mark is committed to the protection of your personal information.  To demonstrate this commitment, we have adopted this privacy policy (this "Privacy Policy"). This Privacy Policy sets out the basis on which we collect and use personal information about you as part of our business activities.


This Privacy Policy is designed to help you understand generally how the Site collects, uses, or discloses information about you. Your visit to the Site is subject to this Privacy Policy and our Terms and Conditions; by accessing the Site, you acknowledge and agree to accept the Privacy Policy, which we may amend at any time. If we update this Policy, we will post the updated Policy here. Any such changes will be effective upon posting. You should consult the "Privacy Policy" bar on the Site each time you visit the Site.

1. What you can find in this Privacy Policy

This Privacy Policy tells you, among other things, what information we gather from you and how we may use or disclose that information. Please read this Privacy Policy carefully, and feel free to contact us using the email address in paragraph XIV, below, or via any of the methods contained on this page if you have questions about this Privacy Policy or if you would like to update or remove information you have provided to us.

Please note that this Privacy Policy applies only to the Site, and not to any other website linked to ours, including any social media websites linked to the Site, nor to any of our service providers or third parties, including any payment processors. We do not control the privacy policies or practices of others. We encourage you to ask questions and read the privacy policies of other websites before you disclose any personal information to them directly or through the Site. This Privacy Policy does not concern your interaction with The SHE Mark in any matter other than your use of the Site, and does not address our privacy practices except with respect to the Site.

In this Privacy Policy, we use the words "personal information" to describe information that is about you and which identifies you. Section 2 below sets out the personal information we collect in more detail. This Privacy Policy Statement outlines the use of personally identifiable information collected on the Site. This privacy notice does not encompass other websites referenced by us in print, online, or in email.

While offering our Site users the advantages and convenience of web-based technologies, we also strive to employ practices to conscientiously and appropriately use information collected about users, affiliates, customers, and other visitors. 

For the purpose of data protection law, The SHE Mark is the data controller with respect to the personal information that we collect and use as part of our business activities. This is because we dictate the purpose for which your personal information is used and how we use your personal information. In certain instances, an entity related to The SHE Mark, such as a local entity, may act as the data controller.

2. What information is collected on The SHE Mark Site, and for what purpose?

The SHE Mark may collect personally identifiable information or non-personally identifiable information.  Personally identifiable information (or identifiable information, or personal information) is information that personally identifies you, such as your name, telephone number, postal address, and email address (or other information that is associated by us with such information), and non-personally identifiable information is information that does not personally identify you, including anonymous information and aggregated data about visitors to the Site. Information can be collected if you submit it to us or it may be collected through technology. 


Generally, information is used to help us better serve our users, affiliates, and customers. We collect non-identifiable information for marketing purposes as you browse our Site - that includes information about what pages you spend time on, what other pages you click through to, etc. This allows us to see how our Site is serving you and how we can do better, learn about how people engage with the information and content we release, and get really excited when we see that someone has looked at our website! This information does not include your contact information. We detail a bit more about how we use this information in paragraph II(b), below.


If you choose to submit identifiable information to use on our Site (for example, if you contact us or request an application and include your name and/or email address), we will collect that personal information for use by us to accomplish your request and reach out to you as necessary. If you submit information to use via online questionnaires, our contractor consideration form, resume submissions, and job postings, we will have access to the information you provide. We will only use and process this information to accomplish the purposes for which you submitted it and to contact you, as detailed further below. We will retain this information for as long as it is useful to us, so if you’d like us to delete the identifiable aspects of that information, please contact us using the email address in paragraph XIV, below.
 

a. Information submitted by you

At times, we may ask you to provide information about yourself in order to better serve you, or you may choose to provide information in order to take advantage of certain features on the Site, or you may submit information via the Application, a payment processor, and/or Site, collectively referred to herein as “SHE Online.” The Application refers to the questionnaire (either sent directly to you, or available through its page on the Site) which can be used solely to apply for SHE Certification through submission of and payment for an application. 


We may use certain personal information we collect about you when you visit and browse SHE Online, including but not limited to when you visit or submit the Application, as part of our normal business operations, to provide services to you, to fulfill obligations to you under agreements, or to send you administrative communications either about your interactions with us or about features of SHE Online, including any future changes to this Privacy Policy. We may use your email address to contact you directly regarding services or products that we believe may be of interest to you, or regarding news and information we believe may be of interest to you. You may also submit your information to us when you use certain features on SHE Online, such as your name, job title, company and/or industry, email address, phone number, mailing address, or whether you have an active project seeking certification, and its certification status. 


For instance, you may provide information if you use any of the following features available on the Site (for purposes of clarity, the following list is not exhaustive):
 

i. To Join Our Mailing List, Submit a Question through our Contact page, or Request a Speaker:

If you sign up on the Site to join our mailing list and receive updates, if you request that one of our team members get in touch with you, or if you submit a question or request additional information about our programs, we will collect, store, and use your email address to send you such information and/or to keep you updated on products and services that may be of interest to you. We will also collect and store your name, as well as other personal information you may choose to provide to us, such as your postal address and telephone number.

ii. If you submit an application to SHE directly and/or via SHE Online:

If you submit an application to The SHE Mark directly or via on SHE Online, you may provide information about your project/employer/company including, for example, project location, number of employees and relevant demographic information, project owner name, project team members' email addresses, mailing address, and/or telephone number, and other relevant information about your project (e.g. cap table, organizational chart, etc.). We will collect, store, and use this information to process and assess your application and provide services to you, including through a customer-only site or back-end (the “SHE Certified Community”). You are advised to keep your log-in information confidential when using SHE Online and/or the SHE Certified Community or any other website to which you are disclosing personal information.

iii. To purchase services, content, publications, or any merchandise that may be available on SHE Online:

In order to make a purchase on SHE Online, you may provide your name, title, address, phone number, email address, and other relevant data. We will collect, store, and use such information in order to process your order, including via our service providers. We do not require this information to obtain access to most areas of the Site, however, you may be required to create a new account or log-in as a registered user prior to accessing some spaces in SHE Online or order any products or services from us. You are advised to keep your log-in information confidential when using SHE Online, or any other website to which you are disclosing personal information.

iv. To complete a survey or use any of the other resources available on the Site:

You may provide information if you choose to participate in an online survey or use other resources on the Site. Such information may include your job title, company, applicable industry, email address, phone number, mailing address, or whether you have an active project seeking SHE Certification. We will collect, store, and use such information to aggregate that data and compile it into trends, follow up with you on your survey results, provide and perfect our services to and for you, and keep you updated about products and services that may be of interest to you.

v. To apply for a job:

If you apply for a job or internship through the Site, you may provide your name, address, phone number, email address, and other relevant information. We will collect, store, and use the information you provide to us for purposes of assessing your application.

If you are providing personal information to us relating to a third party, you confirm that you have the consent of the third party to share such personal information with us, and that you have made the information in this Privacy Policy available to the third party.

Our service providers may collect additional information, including personally identifiable information, such as credit card information or billing address. We advise you to read each service provider’s privacy policy. b. Non-personal information and aggregated data

The SHE Mark uses non-personally identifiable information and aggregated data to better understand how our visitors use the Site; to measure number of visits, average time spent on the Site and pages viewed; to provide visitors with customized services and information; and to gather other relevant statistics and information. The SHE Mark collects this information to measure the use of the Site, provide better service to Site visitors, and to improve the content of the Site. Such information, and other non-identifiable information we derive from individual users' information, allows us to continue to grow and provide you with quality information through more accurate marketing and advertising of the Site. This information is not tied to anything that would identify you (such as your name, email, or IP address).

c. Information collected by technology such as cookies

We and third parties we may engage with, work with, or use, use technologies like cookies to help you use our services more easily, to provide us analytics, and help us continuously improve the Site and services we provide to you. Personal and non-personal information that may be collected using such technologies may include IP addresses, time spent on pages of the Site, location information, and a user's internet service provider. A "cookie" is a small data file that a website can send to your browser, which may then be stored on your hard drive to help the Site "remember" information about you when you return to the Site, such as your preferences for the Site or account identifications.


When you first opened up www.theSHEmark.com, a pop-up bar along the bottom of the page asked you to consent to the collection of certain data by cookies. If you’d like to change your permissions, clear your browser’s cookies and cache and reload the Site, and adjust your response to the pop-up.


The SHE Mark has enabled Google Analytics for this Site, which means Google uses cookies to track and share with us non-identifiable information regarding access and use of the Site. Google may also aggregate and share information about your use of the Site and third party sites, such as your age, gender, and interests, and how and for how long you access the Site. For more information on how Google collects and uses cookies, please see their privacy and terms page, here and navigate to any of the three pages regarding cookies. 


To be clear: The SHE Mark will never merge personally identifiable data with non-personally identifiable data, nor will The SHE Mark endeavor to identify any users of the Site. In the event that The SHE Mark contracts with a third party that provides identifiable information to us, contrary to our express request, The SHE Mark will do everything in its power to erase any identifiable information and identify the source of the problem. If access to identifiable information can be stopped, The SHE Mark will do so. In the event that it cannot be stopped, The SHE Mark commits to working to find an alternative contractor with whom we will not have access to any identifiable information.


You may have the option of setting your browser to reject cookies; however, doing so may affect the performance of the Site or restrict the way in which we may provide our services to you. The "help" portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, Google provides a Google Analytics Opt-Out button for your internet browser, which can be found here.

Types of cookies that may be set on the Site include the following:

i. Functional cookies

  • Account related cookies:  If you create an account with us then we will use cookies for the management of the signup and sign-in process and general administration. These cookies will usually be deleted when you log out; however, in some cases they may remain afterwards to remember your website preferences when logged out.

  • Login related cookies: We use cookies when you are logged in to the Site so that we can remember this fact. This prevents you from having to log in every time you visit a new page. These cookies are typically removed or cleared when you log out to ensure that you can only access restricted features and areas when logged in.

  • Email newsletter related cookies: The Site offers newsletter or email subscription services and cookies may be used to remember if you are already registered and whether to show certain notifications which might only be valid to certain users.

  • Forms related cookies: When you submit data through a form, such as those found on contact pages or comment forms, cookies may be set to remember your user details for future correspondence.

With the use of analytical cookies, sometimes provided by third parties (such as, for instance, third party social media websites), we can collect statistics and metrics about the use of the Site and services. We use services such as Google Analytics, which uses cookies and tracking code to analyze how visitors use the Site. The information collected (including your browser and operating system, IP address, pages visited on the Site, and time spent here) is transmitted to and stored by Google. Google uses this information to evaluate visitors' use of the Site in an aggregate manner, as well as glean certain specific information about You, compile reports on internet usage and activity, and provide other related services. By using tracking cookies, we are able to monitor your movements and behavior on the Site, see what pages on the Site you visit and what services you use. As a reminder, these data are not personally identifiable.

3. How does The SHE Mark use information collected on the Web Site, how long do you hang onto it, and how might The SHE Mark disclose it?

The information we collect is used to improve the content of our Website, enhance the value of our products, and communicate with and provide services to users, affiliates, and customers as follows:

  • The SHE Mark its elected leaders, and its affiliated components have access to your information for purposes of communicating internally and/or with affiliates, providing customer services, and furthering the mission of the organization. Affiliates given access to identifiable information for the purposes set forth in this bullet point are subject to a non-disclosure agreement with us.

  • The SHE Mark may make financial information available to external organizations for purposes of providing affiliates necessary information. Such information does not include identifiable information or email addresses.

  • Customers, registrants, and others granted log-in access to SHE Online and/or the SHE Certified Community may access individual registrant information that registrants choose to include in SHE Online or the SHE Certified Community.

  • The SHE Mark may contact users, affiliates, applicants, registrants, and consumers about events, updates, and opportunities using information submitted to us.

While we will only use information we have for the purposes for which it was collected, we may store that information indefinitely so that we can compare data over time or otherwise. If you’d like us to remove your personal information from our databases or storage, please contact us using the contact information in paragraph XIV, below.

 

We may share non-personal and aggregated information we collect from the Site in a manner permitted by law including to other companies with whom we conduct business, however we will never sell your personally identifiable information.

 

We may disclose your personal information to entities and individuals we engage to perform functions on our behalf and to help us to operate the Site and business and deliver our services to you, or we may disclose certain information if you consent to such disclosure. Some of these entities and individuals may include technology and other consultants, attorneys, accountants, clerical staff, website or database hosting companies, analytics companies, e-commerce providers, and payment processors/financial institutions (for the purpose of processing credit card transactions if you make a purchase on the Site).  For example, we may use a service provider to process payment information, manage our events, provide analytics, or use third-party software to manage our customer relationship management (“CRM”) system. When we use service providers, we provide limited access to your information as necessary so that such service providers can perform the tasks on our behalf.

 

To better provide services to you, including support during the SHE Certification process, we may communicate with project team members with contact information provided on SHE Online or in the SHE Certified Community, including via third party email communication tools and customer service platforms. These entities and individuals will have access to your personal information to the extent necessary to perform services on our behalf. 

 

We may also disclose your personal information if legally required to do so, if requested to do so by a government entity, or if we believe in good faith that such action is necessary to conform to legal requirements or comply with legal process, protect the rights or property of The SHE Mark, prevent a crime, or protect the integrity of The SHE Mark and the Site and personal safety of our users or the public.

 

We may also disclose and transfer your personal information to a third party who acquires any or all of our assets, whether by way of acquisition, merger, consolidation, or purchase of all or a substantial portion of our assets. In addition, in the event The SHE Mark becomes the subject of an insolvency proceeding, whether voluntary or involuntary, The SHE Mark or its liquidator, administrator, receiver, or administrative receiver may sell, license, or otherwise dispose of such information in a transaction approved by the court.

4. How can I opt-out of receiving materials or email communications?

Anyone who does not wish to be contacted by us or an organization with which we might otherwise share contact information may let us know by reaching out to us using the contact information in paragraph XIV, below, by using the contact form here, or by using the “unsubscribe” link at the bottom of our communications to you. Users and customers may request to opt out of specific email communications from The SHE Mark or request an overall opt out of both mail and email communications (with the exception of basic registration and fees renewal mailings). Additionally, registrants may manage their personal information in the SHE Certified Community and choose what information will be accessible there and to whom. We will not send unsolicited messages to you if you do not indicate that you wish to receive such messages.

However, if you as a user do not want your personal information used as otherwise detailed in this Privacy Policy, then you must not use the Site or any part of SHE Online.

If you would like to revoke your previously-given consent to collect and use data, please let us know by reaching out to us using the contact information in paragraph XIV.

5. Tell me about The SHE Mark’s security

The security of your information is important to us, and we endeavor to protect your personal information. However, there is no such thing as perfect security on the internet, and you provide personal information to us at your own risk. The SHE Mark expressly disclaims all liability for any damages, losses, or claims of any kind relating to any personal information that you provide to us or others through the Site. When you use any website, we encourage you to protect your information and use precautions including but not limited to using strong passwords, and not sharing your password and account information with any other person.

6. What about third-party websites?

The Site may contain links to other websites, including, for instance, social media sites and online survey administrators. We cannot be and are not responsible for the privacy practices of such third-party sites. If you provide any information to parties who operate websites that are linked to or from the Site, use or disclosure of your personal information will be governed by those third-party website policies. We encourage you to review other websites' policies and privacy practices before revealing personal information. Under no circumstances shall The SHE Mark have any liability whatsoever for the activities conducted by or at any website accessed from or through the Site.

7. Regarding use of the Site by children:

The Site is not directed to children (persons under 16 years of age), and The SHE Mark does not knowingly collect any personal information from children. If you are concerned about your child's use of the Site, you may use web-filtering technology to supervise or limit access to the Site. If a child under 16 (or, subject to paragraph XII below, the relevant age of consent in your individual jurisdiction) has provided personally identifiable information to us through the Site, a parent or guardian may inform us at the email address found in paragraph XIV, below, and we will use commercially reasonable efforts to delete it from our database, subject to applicable law and this Privacy Policy.

8. Does The SHE Mark engage in online tracking?

The SHE Mark does not track its website visitors over time and across third party websites to provide targeted advertising and therefore does not respond to Do Not Track ("DNT") signals. However, some third-party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. Your browser allows you to set a DNT signal to let third parties know you do not wish to be tracked. You should consult the help pages of your browser to set your preferences.

9. What if I am accessing the Site from outside the United States of America?

This Privacy Policy is intended to meet the laws and regulations of the United States, and despite the global nature of the internet, The SHE Mark makes no claims that the content or the Site are appropriate or may be viewed or used outside the United States. By sending us your data via the Site, you consent to its transfer to and storage within the United States. Those who access the Site from outside the United States do so on their own initiative and are responsible for compliance with local laws, rules, and regulations.

10. What if I have another question? 

If you wish to receive information about how your information is used, wish to change information you have provided, want to request information be removed or deleted, or wish to submit a complaint, please contact us using the email address found in paragraph XIV, below.

11. If you live in California - your California Privacy Rights:

California residents are entitled under California state law to request from us once per year information regarding disclosure of your personal information by The SHE Mark or its subsidiaries to a third party for that third party's direct marketing purposes. If you would like to request such a list please contact us using the address found in paragraph XIV, below.

12. General notices: 

This Privacy Policy is governed by the internal substantive laws of the State of New York in the United States, without regard to its conflict of laws principles. Jurisdiction for any claims arising under or out of this Privacy Policy shall lie exclusively with the state and federal courts within the State of New York. If any provision of this Privacy Policy is found to be invalid by a court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Privacy Policy, which shall remain in full force and effect.

13. How will The SHE Mark inform me about changes to the Privacy Policy?

Periodically we may use collected information for new, unanticipated uses not previously disclosed in our privacy notice. When our information collection and dissemination practices change, we will post the policy changes here on The SHE Mark’s website.  The updated Privacy Policy will take effect as soon as it has been updated.
